A Florida mother accused of child neglect after a doctor found her infant to be malnourished has regained custody of her son, according to her lawyer.

Sarah Markham, 24, of Seminole County, Florida, lost custody of her child five months ago after a doctor directed her to a hospital because her infant son was malnourished and she didnt immediately show up.

She told ABC News affiliate WFTV-TV in Orlando, Florida that she was ecstatic to have her son back.

I'm just so excited ecstatic and about getting him back this whole thing was a nightmare, Markham told WFTV-TV. "I can go back to being a new mom and bonding with him. I am just very happy.

She regained custody of her 5-month-old son after she and her lawyer settled her case with the Florida Department of Children and Families on Wednesday. Markham will have to meet with a state-approved pediatrician to keep custody of her child, according to her lawyer.

Markham declined to speak directly to ABC News through her lawyer.

The Seminole County Sheriff's Office, which oversaw the case through the Seminole County Child Protective Services, told ABC News it cannot speak on the outcome because of state privacy laws.

Markham was arrested on June 24 after a doctor examined the infant and ordered her to go directly to a hospital, according to a public information officer at the Casselberry Police Department.

When Markham did not show up at the hospital, her doctor called police, officials said. Markham was arrested at her apartment and charged with child neglect without bodily harm, police added. She was accused of refusing to give her infant non-vegan formula even though he was dehydrated.

SEMINOLE COUNTY, FL (WFTV/CNN) - A mother and her infant were reunited on Wednesday after five months apart.

Sarah Markham lost custody of her son when he was just 12 days old because she refused a doctor's orders to seek medical treatment for the baby after he lost 10 percent of his birth weight.

She is vegan and believes in a holistic approach to healing.

"I'm just so excited ecstatic and about getting him back. This whole thing was a nightmare and I can go back to being a new mom and bonding with him. I am just very happy," Sarah Markham said.

Sarah Markham was put in jail, and her little boy was taken from her after the baby lost 10 percent of his body weight within his first two weeks of life.

Instead of following a doctor's orders to go straight to the hospital, she bought the boy vegan formula. He's been raised by his grandparents ever since.

"There's no case, there's no abuse, there's no neglect," Bo Markham, the boy's grandfather, said. "There's simply a doctor who has been challenged by a mother, and he didn't like it."

On Wednesday, a judge agreed, throwing out Seminole County Child Protective Services' claims that Sarah Markham is unfit to care for her son.

Attorney Mark O'Mara said he expects the same to happen to her criminal case. "My hopes is that they'll simply dismiss it and not go forward on this at all," he said.

As for Caleb, he's now 17 pounds, and he's still on the same diet.

A vegan mother whose newborn sonwas taken from her several months ago after he began losing weight has regained custody of the child.

On Wednesday, a Seminole County, Florida, judge told Sarah Markham that she would get custody of her son Caleb, with the provision that she provide a nutritionist's report within 10 days.

Markham was arrested in June when her son was less than 2 weeks old. He had lost 10 percent of his body weight. A doctor said Caleb was failing to thrive and told Markham to take her child to a hospital.

Rather than taking the boy to the hospital, Markham wanted to try supplementing breast milk with vegan formula.

The judge agreed, throwing out Seminole County Child Protective Services' claim that Sarah Markham was not fit to care for the child.

Attorney Mark O'Mara said he expects the criminal case against the mother to be thrown out, as well.
