Representing Yourself – County of Alameda – Superior Court …

Posted: at 7:52 pm

People who represent themselves in court are called pro per or pro se litigants. When they file papers with the court, instead of identifying an attorney as their representative on their papers, they write that they are pro per or pro se in the space where the paper asks who the attorney is representing.

Individuals have the right to represent themselves in court. People do this for a variety of reasons. In all criminal matters an individual has the right to be represented by an attorney, and if a person cannot afford an attorney, the Court will appoint an attorney to represent the person. In non-criminal juvenile matters and in some other situations, the Court may appoint an attorney for a person if they cannot afford one. In civil, family law, and probate matters, people may represent themselves. The Court will not appoint an attorney for them. In small claims matters, individuals must represent themselves; attorneys are not allowed to represent anyone in a small claims matter except on appeal. Sometimes the court will recommend that a person seek advice from or hire an attorney to help them, particularly if the case is more complicated or there are issues in the case for which legal advice would be very helpful. However, the Court cannot recommend specific attorneys.

You cannot come to Court and tell the judge that you are nota lawyer and do notunderstand what you aresupposed to do. The judge cannot give you legal advice about your case normake decisions based on your lack oflegal knowledge or understanding. Theymust follow the law. They may suggest you speak with an attorney, but cannot recommend specific individuals or firms to you.

Each type of case has special rules and procedures that apply. To access the Court's Local Rules, click here.

Below are links to some of the basic information you will need if you are representing yourself in Court. Click on the topic you want for more information.

Is There Any Help I Can Get at Court?

If you do not have an attorney, the Self-Help Center and Family Law Facilitator staff and volunteers can assist you with procedural information and instruction on completing forms in the following types of cases:

Assistance is available in person, by telephone, and by writing us. We also have a number of workshops each week where we show people how to complete forms step-by-step and provide information. Workshops are by appointment only, on the following topics: starting a divorce when you have children, starting a parentage (paternity) action, preparing papers to ask for family law orders (Order to Show Cause), preparing judgment papers, Spanish-only family law clinic, and guardianship of the person workshop. In addition, workshops are provided by Volunteer Legal Services Corporation (VLSC) and the East Bay Community Law Center (EBCLC) on: consumer debt (EBCLC and VLSC), evictions for low-incomelandlords (VLSC), and bankruptcy (VLSC). All workshops, except the Spanish clinics, are by appointment only. The Spanish workshops are limited to the first 10 people per session.

We can:

NOTICE RE EARLY CLOSURE OF SIGN-IN: Notwithstanding our posted hours of operation, please be aware that self-help services are provided on a first-come, first-served basis according to the sign-in sheet. Given volume and staffing limitations, and so that we can provide full service to everyone who signs in, sign-in may be closed earlier than the posted closure time. We will be unable to assist anyone who arrives after sign-in has been closed for the day.

We cannot give legal advice. What does this mean? It means we cannot:

What is a Civil Case?Civil cases are all the cases that dont involve breaking the law in such a way that you can be punished by a serious fine or jail/prison time (this is criminal law). Generally, civil cases may be disputes about a contract, damage to property, or someone being injured. They also involve special relationships, like families or dealing with someones property when they die. Common types of civil cases include:

In a court action, the people involved each have a title. This helps make clear each person's role in the court.

Understanding 1: We, as humans, primarily learn to be the way we are; therefore, at any point in life, we can learn to be different. But, it may not be easy to change.

Understanding 2: Self-help is a relatively new, still-to-be-proven approach, involving a few well tested methods, but many methods are unproven. Research supporting self-help approaches is accumulating.

Understanding 3: I prefer to be honest with you about the effectiveness of self-help methods. I'm not going to "talk up" a method or try to "sell" you a product; I'm trying to get you to learn and to think for yourself. Also, I don't want to deceive you

Understanding 4: Any therapist or self-help method may do harm. Reading and self-help seem to rarely do damage. Note: pessimism and the fear of trying to help yourself, resulting in your doing nothing, cause much more harm than any self-help method.

Understanding 5: It may be difficult to measure changes in your adjustment, but you should try. Objective measurement is necessary for honest evaluation. Every self-helper should try to be his/her own researcher.

Understanding 6: Honestly looking at ourselves and changing may be stressful, but we need to do it.

Understanding 7: Do not hesitate to work on your most serious, meaningful, and intimate problems.

Understanding 8: Becoming a good self-helper will probably require a lot of time and effort. You should prepare for problems in advance. It is a life-long task.

Understanding 9: Don't wait for magical solutions. DO SOMETHING to help yourself. Be strong! Confront any resistance to change and challenge all your defeatist attitudes. Learn to believe you can change things.

Understanding 10: This book does not prepare you to be a therapist. Help others, but don't take control and "treat" others.

Understanding 11: If your problem(s) could be caused by physical-chemical factors, see a physician first.

Understanding 12: When your problems are severe and/or your self help efforts are ineffective, seek professional help immediately.

Understanding 13: This book cannot meet all your needs.

Understandings for groups and classes: Be clear about the purposes of your group, know how you can contribute, maintain confidentiality, and help others feel safe. Be sure you understand the reasons for the requirements of your group.

The Psycho-Social Educational Approach The publishing business and self-help books Why is it so hard to find the information you need? The neglect of prevention by books and institutions Why should self-help psychology be given away? How can it be? A brief review of the idea of self-control Our attitude towards "self-help" will influence the future of humanity Summary

Self-Help Being Your Own Best Friend Choosing Goals

Being Your Own Best Friend

Self-help doesnt have to mean lonely years spent with library books telling you what youre doing wrong with your life. Self-help is ultimately about making strong, sensible changes and proving yourself with the support you need to see those changes through. Self-help can, therefore, include a network of counselors, information providers, medical professionals, coaches, and more.

The soul of self-help is the decision to take charge of your own life, your own treatments, and your own goals and outcomes. In a world where many drift along, pointing at this influence and that as explanation for their lack of satisfaction with life, a very few determine to take back control, and captain their own life into satisfying adventures and desired safe harbors. This attitude is at the core of the self-help movement: adult responsibility, adult engagement, and adult process applied to life itself.

Self-help can be pursued in many ways, but its always a dynamic, involved process in which the patient refuses a passive role. Rather than being worked upon, the self-realized individual works upon herself with the aid of professional allies.

Finding allies to work with can be a challenge. It requires having planned far enough ahead to at least choose one prepared ally as a starting point. In many cases, the first ally will be a doctor, a civil servant, a member of the religious clergy or an agent of a sound professional referral agency. Any of these can then help provide information on available professionals, useful areas of expertise, and best practices.

Once you have a basic team of allies in place, you can begin setting basic goals. Dont go overboard: a to-do list more than about six lines long is likely to overwhelm, especially in the first stages of a major life-restructuring. Its better to choose one, or possibly two long-term goals, no more, and to then determine a path to that goal, from supportive ways to think to necessary ways to behave. Good allies will have suggestions for method and technique, and for timing within your lifes long arcs, but will allow the patient to choose the goals and accept or reject certain techniques.

The advantage of providing yourself with professionals, either as information sources or as actual allies, lies in the effect technique can have on self-help outcome. Working alone from a book all techniques seem equally valid, presented by equally prepared and impassioned advocates. A trained and informed professional, whether a care giver or an educator, can help sort out the techniques and methods most suited to your personal circumstance in ways you cant. Together you and those you have chosen for your team will put together a system of best practices tailored to you, your life, and your goals, with support built in, regular rewards and check points, and time to evaluate your progress.

Whats certain is that only by actually getting under way, and seeing your project through to a resolution, will you accomplish the things you set out to do. This is the follow-through stage of your self-help campaign, and in the end its the aspect your chosen friends and allies can only observe, not control. Self-help takes many forms, but the follow-through is of necessity self-oriented, self-sustained, and self-rewarding.

Remember, the central element of self-help isnt isolation, but self-motivation and control. Dont feel shy about building a team of supporting players! Just remember that youre living your life, and they can help, but they cant take over.

Self Help for Adult ADHD

By Tammy Preston, MS

While taking drugs and attending therapy are two popular and sometimes necessary ways to cope with ADHD, some people have managed their condition themselves through the dozens of self-help methods out there. Once someone knows that they have attention deficit hyperactivity disorder, they can start to compensate for its effects and manage the symptoms themselves, empowering themselves and becoming more confident along the way.

While environmental theories of why people have ADHD still persist, recent brain chemical studies have shown that the cause of ADHD lies in the biochemical processes in the neurotransmitters in the brain, and that it has a genetic factor. Just because ADHD is something that people have not caused themselves however, does not mean that it is something they can not have a substantial role in managing.

Doing things like educating themselves about their condition, scheduling their life with their condition in mind, and finding support amongst friends can lead someone to have a much happier and healthier relationship to their condition. By giving themselves more time than they think to perform a task, setting themselves reminders, and just leaving a little breathing space into their schedule, some people are learning to manage their condition without the help of drugs. Job performance and social skills can also be helped greatly through techniques of mindfullness and practice.

It may be harder for someone suffering with attention deficit hyperactivity disorder to do certain things, but this does not make it impossible, and many adults with the condition are learning alot about themselves along the way.

Allie Lane was full of excitement and activity. On this short street in the small town of Luling in St. Charles Parish, Louisiana, I was proud to celebrate National Homeownership Month by breaking ground for a new home.

I humbly watched as Jacqueline Campbell, Kimberly Dunn, and Paulette Alexander eagerly picked out shovels to participate in the symbolic dirt toss at the site cleared for construction of the next Self-Help home on Allie Lane. They are all currently renting and ready to roll up their sleeves and go to work to build a better future together for their families. Read more

This year, Independence Day will be even more meaningful for tens of thousands of families across the nation. With financing assistance from USDA, they will be able to gather their loved ones in their own homes and back yards to celebrate the holiday as homeowners.

As the Administrator for USDAs housing programs, I spent the past weeks celebrating National Homeownership Month with rural families who are achieving the American Dream with USDA assistance. On the final day of the month-long celebration, I joined families who are now constructing their homes through USDAs Mutual Self-Help program, as well as another group of families moving into their new homes just in time to celebrate the Fourth of July. Recently, I visited the Habitat for Humanity homes on Cape Cod, Massachusetts in celebration of National Homeownership Month, a time to recognize the important role that housing plays in the economy. The construction of these homes was made possible through loans from USDA Rural Development (RD).

The partnership between USDA Rural Development and the Cape Cod Chapter of Habitat for Humanity continues to help provide numerous low-income families with safe, affordable, and well-built homes. USDA Rural Development and the Cape Cod Chapter of Habitat for Humanity first partnered in 2011. In FY 2013, USDA Rural Development financed four out of five of the Habitat homes built on Cape Cod, and they are currently on track to finance eight more Habitat homes being built on Cape Cod in FY 2014. Wayne Bodley (far right) built his home through the Self-Help program with assistance from USDA Rural Development and the Housing Assistance Corporation. Bodley designed the bear which is displayed in downtown Hendersonville, NC, and will be auctioned off to benefit the local Self-Help program.

In celebration of USDAs annual Homeownership Month,I toured a flourishing neighborhood tucked in the woodsofEdneyville, North Carolina. Along with me were familieswho never thought it possible to own a home or have a yard for their children or a garden. Their dreams were realized by building not only their own home, but the homes of their neighbors too! In the process, they also built enduring bonds of a caring community.

This neighborhood is beingdeveloped by the private, nonprofit Housing Assistance Corporation (HAC)of Hendersonville using Rural Developments Self-Help Housing program. Since 1971, USDA has helped buildmore than50,000 across the nation. Through theSelf Help Housing program, homeowners save money and earn sweat equity toward their homes by completing 65% of the labor. Ten to 12 families pool their efforts and work a minimum of 40 hours a week working on all the homes and no one moves into their home until every home is completed. Working together, families pour foundations, frame homes, install electrical wiring, hang doors and windows, and lay tile and paint. Their sweat equity qualifies as their down payment. Once completed, USDA Rural Development provides the families with mortgages through the Single Family Housing Direct Loan Program. Read more

By mid-morning the wind was howling and blowing the auburn colored sand across Zuni Pueblo located in western New Mexico.

But this was the last thing on the minds of Kay Panteah, Reyanna Nastarcio and Martha Sheche tribal members of Zuni Pueblo. This is the day they celebrate the completion of construction of their new homesthe homes they built with their own hands with the help of family and friends.

At last, this day has finally arrivedafter all of those days of hanging drywall, driving nails, and painting walls. After a year of hard work they are being honored by an age-old tradition where their community comes together and celebrates a special feast day. A celebration that includes a blessing of thanks, song and dance by the Zuni Olla Maidens where they rejoice in the homecoming for these three women who have worked hard to attain the title of homeowner and to create a home for their families. Fibromyalgia – Self-help – NHS Choices

Posted: at 12:44 pm

If you have fibromyalgia, there are several ways to change your lifestyle to help relieve your symptoms and make your condition easier to live with.

Your GP, or another healthcare professional treating you, can offer advice and support about making these changes part of your everyday life.

There are organisations to support people with fibromyalgia that may also be able to offer advice. VisitUK Fibromyalgia's support group section for a list of support groups across the country. You may also find it helpful to talk to other people with fibromyalgia on this online community.

Below are some tips that may help relieve symptoms of fibromyalgia. You can also read more information about living with pain.

As fatigue (extreme tiredness) and pain are two of the main symptoms of fibromyalgia, you may find that you're not able to exercise as much as you'd like. However, an exercise programme specially suited to your condition can help you manage your symptoms and improve your overall health.

Your GP or physiotherapist (healthcare professional trained in using physical techniques to promote healing) can design you a personal exercise programme, which is likely to involve a mixture of aerobic and strengthening exercises.

Aerobic activities are any kind of rhythmic, moderate-intensity exercises that increase your heart rate and make you breathe harder. Examples include:

Research suggests that aerobic fitness exercises should be included in your personalised exercise plan, even if you can't complete these at a high level of intensity. For example, if you find jogging too difficult, you could try brisk walking instead.

A review of a number of studies found that aerobic exercises may improve quality of life and relieve pain. As aerobic exercises increase your endurance (how long you can keep going), these may also help you function better on a day-to-day basis.

Resistance and strengthening exercises are those that focus on strength training, such as lifting weights. These exercises need to be planned as part of a personalised exercise programme; if they aren't, muscle stiffness and soreness could be made worse.

A review of a number of studies concluded that strengthening exercises may improve:

People with fibromyalgia who completed the strengthening exercises in these studies said they felt less tired, could function better and experienced a boost in mood.

Improving the strength of your major muscle groups can make it easier to do aerobic exercises.

If you have fibromyalgia, it's important to pace yourself. This means balancing periods of activity with periods of rest, and not overdoing it or pushing yourself beyond your limits.

If you don't pace yourself, it could slow down your progress in the long term. Over time, you can gradually increase your periods of activity, while making sure they're balanced with periods of rest.

If you have fibromyalgia, you will probably have some days when your symptoms are better than others. Try to maintain a steady level of activity without overdoing it, but listen to your body and rest whenever you need to.

Avoid any exercise or activity that pushes you too hard, because this can make your symptoms worse. If you pace your activities at a level that's right for you, rather than trying to do as much as possible in a short space of time, you should make steady progress.

For example, it may help to start with gentler forms of exercisesuch as tai chi, yoga andpilates before attempting more strenuous aerobic or strengthening exercises.

If you have fibromyalgia, it's important to regularly take time to relax or practice relaxation techniques.Stress can make your symptoms worse or cause them to flare up more often. It could also increase your chances of developing depression.

There are many relaxation aids available, including books, tapes and courses, although deep-breathing techniques or meditation may be just as effective. Try to find time each day to do something that relaxes you. Taking time to relax before bed may also help you sleep better at night.

Talking therapies, such as counselling, can also be helpful in combating stress and learning to deal with it effectively. Your GP may recommend you try this as part of your treatment.
